All Affiliates, contacts and payees must have reached the age of majority under applicable law where they reside and/or do business, and must be no younger than 18 years of age in any case. You represent and warrant that you have reached the age of majority under the laws of the state or locality where you reside and/or do business. Only one account is allowed per company or organization unless prior approval has been granted directly by our administrators.
This agreement describes the entire terms and conditions for participation in the ATM Group LLC ( Barebacked.com ) Affiliate Program. In this agreement, the term "Affiliate" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "we" or "our" refers to ATM Group LLC ( Barebacked.com ).
ATM Group LLC ( Barebacked.com ) will create a unique URL for you when you submit a complete Affiliate Enrolment Form.
We currently offer several payment programs.
For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered. Commissions will only be paid on sales which are made through qualified Affiliate links. The rates are indicated as follows: 50%-65% for each referred customer (signup) that purchase a paid trial via Credit Card.
Additional programs may be introduced and will be governed by these Terms & Conditions. Signups generated by checking/ach will be credited only for sales from the United States and Canada. We will pay you for signups to the program website(s) received from a banner(s), text link(s) or blind link(s) served from your website.
Incentivised sales or encouraging membership termination or cancellation, or engaging in any other promotional activities which we deem fraudulent will subject your account to termination and forfeiture of any funds owed to you.
Affiliates that offer rewards, additional services, additional memberships to other sites, or money to surfers in exchange for a trial signup will have their
account terminated.Webmasters, their relatives or employees signing up for a trial using their own link codes will have their account terminated and will
not be paid. Affiliates that attempt to cheat, defraud or mislead us in any way will be terminated from our affiliate program.
While we encourage you to join any or all of the sites you can promote, no payment will be issued if it is found that you attempted to earn credits with us by signing up for the site. This constitutes cheating and will result in forfeiture of any funds owed that account.
ATM Group LLC ( Barebacked.com ) will send a check for the applicable commissions within the framework of their policies. (Payouts are net 30) If any order that generated a referral fee is returned by the customer, or if there are any returned checks or charge-backs, the amount will be deducted by ATM Group LLC ( Barebacked.com ) from the next payment.
Payments are sent on the 2nd for the period of the 16th-31st of the previous month, and on the 16th for the period of the 1st-15th of the current month. You
will only be paid if your account balance is at or above the minimum payout you choose when signing up. In the event that the scheduled payment date falls on a weekend or federal holiday, payments will be issued the following business day.
Customers who purchase products and services through the Affiliate Program will be deemed to be customers of ATM Group LLC ( Barebacked.com ). Accordingly, all ATM Group LLC ( Barebacked.com ) rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. ATM Group LLC ( Barebacked.com ) policies will always determine the price paid by the customer.
Affiliates must have an active Affiliate link in order to qualify for commissions.
ATM Group LLC ( Barebacked.com ) reserves the right not to accept any site into the Affiliate Program based on site content. Sites that Do Not Qualify for the ATM Group LLC ( Barebacked.com ) Affiliate Program include sites which:
promote violence
promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
promote illegal activities
violate intellectual property rights
Atm Group Enterprises LLC in no way participates in mass unsolicited emailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the ATM Group LLC ( Barebacked.com ) Affiliate Program, with no payments. Bottom line: If you spam you are out!
You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.
We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the rules of the American Arbitration Association, and the finding of the Arbitrator shall be binding on all parties. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
By signing up , you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
We will not be held responsible for loss due to downtimes resulting from complications with our hosting equipment, technical errors or any other unforseeable circumstances. Our files will prevail in determining all statistics including but not limited to the amount of valid hits, signups, referrals, cancellation, credits and any commissions or referral fees owed to any Affiliate pursuant to this Agreement. Any discrepancies or errors must be brought to our attention within 30 days or they will be deemed permanently waived.
We reserve the right to cancel this program at any time, without prior notification. In such cases you will be notified immediately and paid for ALL accumulated funds up to that point in time, except in cases where it is determined you have cheated by violating this agreement.
We make no representations regarding the amount of income you can or will generate by promoting our products. Individual results vary.
We reserve the right to deny any prospective sponsee admittance into our program for any reason, based on the content of their website or for any other reason. All monies are paid by in U.S. dollars.
The term of this Agreement will begin upon our acceptance of your application to join the Program, and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination. Notice sent to your email address (as listed in our records) is considered sufficient notice of termination of the Agreement. If the Agreement is terminated because you have violated any of the terms of the Agreement, any balance in your account will be forfeited.
We reserve the right to withhold your final payment for a reasonable time to ensure that the correct amount is paid. These terms and conditions are subject to change without notice. While we may make reasonable efforts to notify you of substantive changes to this agreement, It is your responsibility to check this page regularly to ensure that any changes are noted.
